The two primary forms of Alternative Dispute Resolution (ADR) are mediation and arbitration. They are the alternatives to resolving disputes through a much elaborate process of court litigation. Commercial and real estate contracts now require the concerned parties to engage in some form of ADR either before the court proceedings (usually mediation) or in lieu of it (usually arbitration). ADR can also be a cost-effective solution to resolve a dispute or it can end up as an unnecessary step towards resolution.
